Copyright in concept sketches or drawings, unused design concepts, whether in hard copy or electronic digital format, developed for the client by AdSign, remain the property of AdSign.

AdSign retains the right to make use of designs, drawings, logos, artwork and layouts whether in hard copy or electronic digital format for the purposes of promoting and/or advertising our business and services offered, for award submissions and in publications on or about the work we do.

If the client or AdSign wishes to cease work on a project, AdSign retain the right to receive compensation for material outlays and the time spent on design up to the date work ceased.

Terms and conditions for photography, illustration or other commissioned work are currently excluded and can be negotiated prior to commencement of that stage.

While AdSign will conduct preliminary searches, it is the responsibility of the client to ensure that the use of the design does not breach any applicable laws of copyright, trademark or passing off. A trademark search can be done through IP Australia or a suitable patent lawyer.

AdSign will supply all necessary graphic materials at any stage for this purpose. Project fees and costs are payable, irrespective of trademark search outcomes. The client warrants that the desired designs are not a breach of any third party’s intellectual property rights. To the extent AdSign can rely on the above warranty, AdSign warrants that all work done in the creation of the design will be original and not a breach of any third party’s intellectual property rights.
